Estate and Trust Administration
Scarborough McNeese Oelke & Kilkenny, PC

We act as legal counsel for court-appointed personal representatives, usually a family member or financial institution, in the administration and settlement of decedents' probate estates.

We also act as counsel for successor trustees of decedents' revocable living trusts, assisting the successor trustee through the administration process, which usually entails termination of the trust with either distribution to the individual residuary beneficiaries or funding and administration of testamentary trusts named as beneficiaries. Additionally, we frequently represent individuals in non-probate estate administration cases, as well as "claiming successors" in less formal "small estate" settlement proceedings.
